Pickleball Court Liability Waiver and Release of Claims
By booking and/or using the pickleball court ("Facility") provided by The Court ("Provider"), located at 38 Combridge St, you ("Participant") acknowledge and agree to the following terms:
- Assumption of Risk
I understand that participation in pickleball and use of the Facility involves inherent risks, including but not limited to slips, falls, collisions, or other physical injuries. I voluntarily assume all risks associated with such participation, whether known or unknown.
- Release of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless the Provider, its owners, employees, agents, representatives, and affiliates from any and all liability, claims, demands, causes of action, or expenses (including attorneys' fees) arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me while participating in activities at the Facility.
- Indemnification
I agree to indemnify and hold harmless the Provider from any loss, liability, damage, or cost, including court costs and attorneys' fees, that may result from my use of the Facility, whether caused by negligence or otherwise.
- Medical Treatment
I authorize the Provider to obtain emergency medical treatment for me in the event of injury or illness, and I agree to be responsible for any costs incurred.
- Age Requirement
I affirm that I am 18 years of age or older. I understand that use of the Facility is strictly limited to adults age 18 and above.
- Code of Conduct
I agree to follow all posted rules and instructions provided by the Provider or its staff. Failure to comply may result in suspension or revocation of Facility access without refund.
- Binding Agreement
I understand that this agreement shall be binding upon me, my heirs, executors, administrators, and assigns, and shall be governed by the laws of the Province of Ontario.
By booking and/or entering the Facility, I confirm that I have read, understood, and voluntarily accept the terms of this waiver and release of liability.
